On XNUMX March XNUMX, the Deutsches Institut für Bautechnik (German Institute of Structural Engineering, DIBt) (www.dibt.de) issued a notice that Construction Products Lists A and B and list C (issue 29.03.2019/2015 with modifications 2/2016 and 1/2016) were repealed as of 2 April 01.04.2019.

The Model Administrative Provisions – Technical Building Rules (MVV TB) have now been published and introduced in all Germany’s federal states as corresponding state regulations. The law in most federal states relates to MVV TB issue 1/2019, dated 15.01.2020 January 07.08.2020 (or the version of 1 August 2017 with printing errors corrected). In some federal states, it still relates to MVV TB issue 31.07.2017/11.12.2017, dated 2020 July 1 (or the version of 19.01.2021 December XNUMX with printing errors corrected). In others, the law relates to MVV TB issue XNUMX/XNUMX, dated XNUMX January XNUMX.

The latest versions of the model provisions and model decrees, information on how the model provisions have been transposed into local law in the individual federal states, and details on the repeal of Construction Products Lists A and B and list C are found on the websites of the German Conference of Construction Ministers/IS-Argebau (https://www.bauministerkonferenz.de) and the Deutsches Institut für Bautechnik (German Institute of Structural Engineering, DIBt) (www.dibt.de)

The federal states’ provisions are published on their websites on local law and construction law.

The Model Administrative Provisions – Technical Building Rules regulate construction requirements and are divided into:
Part A: Technical building rules that must be complied with to fulfil the basic requirements for structures:
mechanical strength and stability, fire protection, hygiene, health and environmental protection, safe and accessible use, noise protection and heat protection;
Part B: Technical building rules for components and special-purpose designs that must be complied with in addition to the technical building rules listed in Part A;

Part C: Technical building rules for construction products without the CE marking, and for construction products and construction techniques for which a national technical test certificate is required;
Part D: Construction products that do not require proof of usability.

The MVV TB is continuously updated. Further amendments have already entered the European Commission’s notification procedure as of 2020. When it is completed, they will be published on the above sites.

The Construction Products Directive (CPD), which was replaced by the EU Construction Products Regulation (CPR) on 1 July 2013, was issued to harmonise technical rules and to align the legal and administrative regulations of the EU Member States. Among other things, the CPR stipulates the conditions for placing construction products on the market and making them available.

  • Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC.

For a transitional period, the unified European fire protection classification concept that has been developed in recent years will apply on an equivalent basis and as an alternative to the previous German classification system, based on the DIN 4102 series of standards. Manufacturers and users have the option of providing evidence of fire behaviour or fire resistance either on the basis of DIN 4102 or – as applicable – on the basis of DIN EN 13501-1 (fire behaviour) or DIN EN 13501-2 (fire resistance).

At the national level, preventive and technical fire protection has been put in concrete form by the introduction of the Model Building Regulation and the model directives in the federal states.

In addition, from before the introduction of the MVV TB, there are technical rules on planning, dimensioning and designing structural installations and their components. These become generally binding when they are introduced by the building authorities as part of Technical Building Rules. These can be found in the “PDF downloads” collection.
